Rome, October 9, 2026. Law firm Lener & Partners has advised YouHodler Italy S.r.l., a subsidiary of the YouHodler Group, in the authorization process as a crypto-asset service provider (CASP) under Regulation (EU) 2023/1114 on markets in crypto-assets (MiCAR) and Italian Legislative Decree No. 129/2024. Consob, having consulted Banca d’Italia, issued the authorization through Resolution No. 24156 on October 8, 2026.

The authorization covers five services under the MiCAR framework: custody and administration of crypto-assets on behalf of clients; exchange of crypto-assets for funds; exchange of crypto-assets for other crypto-assets; execution of orders in crypto-assets on behalf of clients; and transfer of crypto-assets on behalf of clients.

The Italian MiCAR Landscape

The text of Resolution No. 24156, published on the Consob website, confirms the authorization date and references letters a), c), d), e), and j) of Article 3, paragraph 1, point 16 of Regulation (EU) 2023/1114. That means YouHodler Italy has been authorized for five of the ten possible services listed under MiCAR. The company submitted its application on December 29, 2025, and the resolution will be transmitted to the European Securities and Markets Authority (ESMA) for entry in the CASP register.

Italy’s MiCAR implementation adds a layer of national complexity that doesn’t exist in every EU member state. Consob handles authorization and market conduct supervision, while Banca d’Italia oversees custody arrangements, payment flows, and anti-money-laundering compliance. Operators who cleared the transition without a license are now facing scrutiny: Consob has forwarded 165 of the 167 non-compliant operator records from the ESMA register to the relevant Italian authorities.

What Comes Next for Authorized CASPs

Authorization is the starting line, not the finish line. Following the Consob green light, the operational requirements kick in immediately. Banca d’Italia has specifically flagged transfer controls as a priority area, with no minimum threshold for transaction monitoring. By the joint Consob and Banca d’Italia press release of June 30, 2026, nine entities had been authorized to operate in Italy at the close of the transitional period: eight CASPs and Banca Sella.

The practical sequence after authorization is already playing out in the market. Cryptosmart, for instance, launched its first new product following its own MiCAR authorization, adding more than 30 tokens to its platform. YouHodler Italy will face similar operational decisions as it rolls out its five licensed services to Italian retail and institutional clients.

For investors and users wanting to verify whether an operator is genuinely licensed, Consob maintains an official register and has transmitted the non-compliant operator list to ESMA. Checking the ESMA CASP register directly remains the most reliable first step before using any platform.
